1. Services
ServicesAgentcy AI provides AI-powered communication and workflow automation services for businesses, which may include missed-call text-back, automated phone answering, chat, lead qualification, appointment scheduling, review requests, and marketing automation ("Services"). Specific deliverables, packages, and fees are described on our Site or in a written proposal or order form, which together with these Terms forms the agreement between us.
2. Client Responsibilities
Client Responsibilities You agree to: Provide accurate business information needed to configure the Services Obtain all necessary consents from your own customers for communications sent on your behalf (including SMS consent), and use the Services in compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and carrier messaging policies Review and approve automated message content we configure for your business Not use the Services for unlawful, deceptive, or harassing communications
3. Fees, Billing & Cancellation
Fees, Billing & Cancellation Services are billed monthly in advance, plus any one-time setup fee stated at purchase Usage-based costs (e.g., call minutes, message volume) may apply as described in your package Subscriptions are month-to-month; you may cancel at any time effective at the end of the current billing period by written notice to Admin@agentcyai.net Setup fees are non-refundable once setup work has commenced, except as provided under the Guarantee below
4. 30-Day Guarantee
30-Day Guarantee If, during your first 30 days of active service, the Services fail to capture or recover any missed customer opportunities for your business, you may request a refund of your first month's subscription fee by written notice within 10 days after the 30-day period ends. This guarantee applies once per client and does not cover usage-based third-party costs.
5. Third-Party Services
Third-Party ServicesThe Services are built on and depend upon third-party platforms and carriers (including telecommunications providers, software platforms, and AI model providers). We are not responsible for outages, delays, message filtering, or changes imposed by third parties, though we will make commercially reasonable efforts to restore affected Services promptly.
